The Supreme Court mandates a CBI inquiry into Supertech’s NCR projects, highlighting a builder-bank nexus affecting thousands of homebuyer


In a significant move to address alleged malpractices in the real estate sector, the Supreme Court of India has directed the Central Bureau of Investigation (CBI) to initiate a preliminary inquiry into the projects of Supertech Limited in the National Capital Region (NCR). This decision stems from concerns over a potential “unholy” alliance between banks and developers, which has adversely impacted numerous homebuyers.

The court’s directive is rooted in the controversial subvention schemes, where banks disbursed 60-70% of home loan amounts directly to builders without ensuring project completion within stipulated timelines. Consequently, thousands of homebuyers found themselves burdened with loan repayments for properties that remained incomplete or undelivered.

A bench comprising Justices Surya Kant and N Kotiswar Singh took cognizance of an affidavit filed by the CBI, leading to the following directives:

  • Formation of a Special Investigation Team (SIT): The Directors General of Police (DGPs) of Uttar Pradesh and Haryana are to provide a list of officers, including Deputy Superintendents of Police (DSPs), inspectors, and constables, to assist the CBI in constituting the SIT.
  • Appointment of Nodal Officers: Senior officials from the Greater Noida Authority, Noida Authority, Ministry of Housing and Urban Affairs, Institute of Chartered Accountants of India (ICAI), and the Reserve Bank of India (RBI) are to designate nodal officers within a week to facilitate the SIT’s operations.
